Dealer Certification: Important Facts that you must keep in Mind

Dealer Certification is the authorization to deal in weights and measuring products in India. The Legal Metrology department issues it under the Legal Metrology Act, 2009 to importers and manufacturers of products that belong to the weights & measures domain. This article dispenses the significant facts about this authorization that you should know before applying for it.

The Indian government holds weights & measuring products on a separate pedestal. They form the foundation of all the articles one sells, imports of manufactures in India. Therefore, the government established Legal Metrology Department a long time ago. As per the rules that this organization drafted, a dealer needs to obtain a dealer certification before becoming a purveyor of weights and measuring products.

This article touches upon its critical facts.

Let’s take a look

Only two types of entities are eligible to obtain the Dealer Certification.

As per the rules of the Legal Metrology Act, a dealer license is only for the following two entities:

  1. Manufacturers: Manufacturers are entities that produce weights and measuring products and put them on sale in India. They have the permission to procure a dealer license from the Legal Metrology Department.
  2. Importers: Importers are entities that import weights and measure products to sell them in Indian markets. Like the manufacturers, they too require a dealer certification.

If you are neither the manufacturer nor the importer of such articles, LMA rules prohibit you from obtaining a legal metrology license.

Applicants must adhere to the eligibility criteria before applying for the license.

To apply for the license, the applicant must first adhere to the conditions mentioned below:

  1. Finite validity of the authorization: The applicant must be capable of meeting the dealership requirements for five years as it’s the validity of the dealer license.
  2. Must be comfortable with the timeline of the license: The applicant must be agreeable with the different timelines to obtain the certificate as they would vary from state to state.
  3. Multiple certificates for multiple states: Dealer Certification is not centralized. Thus, one must obtain multiple authorizations if the requirement is to deal in weights and measure products in many territories.

The applicant must put together all the documents needed for the license.
